3. Products and Product Information

We supply stainless steel gutter brackets, gutter-related components and bespoke metal brackets.

We make reasonable efforts to ensure that product descriptions, photographs and specifications on our website are accurate. Minor variations in appearance, finish or dimensions may occur where reasonably necessary.

Product descriptions and specifications may be changed or updated from time to time. We reserve the right to discontinue products or limit quantities where necessary.

Colours and product appearance may vary depending on your screen, device settings and configuration.

Unless expressly stated otherwise, products are supplied as described on the relevant product page.

4. Suitability of Products

Customers are responsible for checking that the selected product is suitable for their intended application, gutter profile, dimensions and installation method.

Where a product is made or modified to your measurements, drawings, specifications or instructions, you are responsible for ensuring that the information supplied to us is accurate and suitable for the intended application.

Where you are unsure about product suitability, you should contact us before placing your order.

5. Customer Information and Accounts

You must provide accurate, current and complete information when placing an order, including your name, contact details, delivery address, product sizes, quantities and any measurements or specifications required for bespoke products.

If you create an account, you are responsible for maintaining the security of your account credentials and for activity carried out through your account. You must not transfer or assign your account to another person.

6. Consumers and Business Customers

If you are purchasing wholly or mainly for purposes outside your trade, business, craft or profession, you are a consumer and your statutory consumer rights apply.

Nothing in these terms is intended to exclude or limit any rights you have under applicable consumer protection legislation.

If you are purchasing in the course of a business, different provisions may apply, particularly in relation to returns, cancellation and liability. A business customer confirms that it is purchasing for business purposes and has authority to enter into the contract.

7. Orders and Contract Formation

Placing an order constitutes an offer to purchase the products selected. A contract is formed when we accept the order, normally by confirming the order or commencing fulfilment.

We reserve the right to accept or decline an order at our discretion and may contact you if we need to clarify information before accepting an order.

Payment must be received in full before an order is dispatched unless alternative payment terms have been agreed with us in writing.

Please check your order carefully before submitting it. We may be unable to accommodate cancellation requests once an order has been accepted or fulfilment has commenced.

Where we do not accept, change or cancel an order, we will endeavour to notify you using the contact details provided.

Your purchases are subject to the applicable cancellation and returns provisions set out in these terms and our Refund/Returns Policy.

8. Prices, Promotions and Payment

Prices are those displayed on the website at the time of ordering unless otherwise agreed in writing.

Prices, discounts and promotions may change without notice. The price applicable to your purchase will normally be confirmed in your order confirmation.

We reserve the right to correct obvious pricing or description errors. If an obvious error results in an incorrect price, we may contact you before accepting the order and give you the option to proceed at the correct price or cancel the order.

Unless expressly stated otherwise, customers are responsible for any applicable delivery, customs, import or other charges.

You agree to provide accurate payment information and confirm that you are authorised to use the payment method provided.

9. Dispatch and Delivery

We aim to dispatch orders as quickly as possible and, wherever reasonably practicable, on the next working day following receipt of a completed and paid order.

Next-working-day dispatch is our normal target and is not a guaranteed delivery date.

Orders will normally be sent using a signed-for or tracked delivery service. Once an order has been handed to the carrier, delivery times are subject to the carrier's service and to events outside our reasonable control.

We are not responsible for carrier delays, customs processing or other delays outside our reasonable control. Delivery times are estimates unless expressly agreed otherwise.

Customers should inspect goods as soon as reasonably practicable after delivery. Apparent damage, shortage or an incorrect item should be reported promptly, preferably with photographs, so that we can investigate and take appropriate action. This does not affect statutory rights.

10. Ownership and Risk

Risk in products passes to the customer in accordance with applicable law. For consumers, statutory rules relating to delivery and risk apply.

Ownership of products remains with us until we have received payment in full for those products.

11. Consumer Cancellation and Returns

For most online purchases of standard stock products, consumers have a statutory right to cancel within 14 days of receiving the goods, subject to the applicable exceptions under the Consumer Contracts Regulations 2013.

The right to cancel does not generally apply to goods that are made to the consumer's specifications or are clearly personalised.

Where a consumer validly cancels, goods should be returned in accordance with our instructions. Unless the goods are faulty, incorrect or otherwise our responsibility, the consumer is normally responsible for the direct cost of returning the goods.

Refunds will be processed in accordance with applicable consumer law. Nothing in these terms affects statutory consumer rights.

12. Business Returns

Returns of correctly supplied stock products from business customers are accepted only at our discretion and must be agreed with us before the products are returned.

Where we agree to accept a business return, a 50% restocking charge will normally be applied to the invoice value of the returned products. The customer is responsible for the cost of returning the goods and any original carriage costs.

Returned products must be unused, unaltered, undamaged and in a resalable condition. Products that have been installed, modified, cut, drilled, damaged or otherwise altered will normally not be accepted.

Custom, bespoke or made-to-specification products are not normally returnable unless they are faulty, incorrectly supplied or otherwise agreed by us in writing.

13. Faulty, Damaged or Incorrect Products

If products are faulty, damaged in transit or incorrectly supplied, please contact us promptly with details of the issue and, where appropriate, photographs.

We will assess the issue and, where we are responsible, may repair, replace or refund the affected product as appropriate and in accordance with applicable law.

This section does not restrict any statutory rights available to consumers.

14. Warranty

Unless otherwise stated in writing, our products are covered by a 12-month warranty from the date of delivery against manufacturing defects arising under normal and reasonable use.

The warranty does not normally cover fair wear and tear, accidental damage, misuse, neglect, incorrect installation, unsuitable storage, failure to follow installation or care instructions, modification or repair by third parties, damage caused by unsuitable fixings or associated components, or products manufactured to an incorrect customer specification.

The warranty applies to the product supplied by us and does not extend to other parts of a guttering or building system, installation work, consequential damage or workmanship carried out by third parties.

The warranty does not affect or replace any statutory rights that apply to consumers.

15. Events Outside Our Reasonable Control

We will not be responsible for delay or failure caused by events outside our reasonable control, including carrier delays, industrial disputes, shortages of materials, severe weather, fire, flood, power failure, government action or other events beyond our reasonable control.

Where such an event affects an order, we will take reasonable steps to keep the customer informed and to fulfil the order as soon as reasonably practicable.

16. International Orders

For orders delivered outside the United Kingdom, the customer may be responsible for import duties, taxes, customs charges and local clearance fees. Delivery times may also be affected by customs procedures.

You must not use the website for unlawful or malicious purposes, to infringe intellectual property rights, to transmit misleading information, to introduce viruses or malicious code, to scrape or collect information improperly, to interfere with website security, or to otherwise disrupt the operation of the website.

We reserve the right to suspend or terminate access where we reasonably believe these requirements have been breached.

18. Third-Party Services and Links

Our website may contain links to or functionality provided by third parties. We do not control or accept responsibility for third-party websites, services, content or transactions.

If you access a third-party website or use a third-party service, you do so at your own risk and should review that provider's terms and policies before proceeding.

21. Feedback and Reviews

If you submit reviews, suggestions, ideas or other feedback to us, you confirm that you have the necessary rights to provide that material and that it does not infringe the rights of another person.

Subject to applicable law, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, publish and display such feedback for purposes connected with operating and promoting our business and Services.

We may remove or decline to publish feedback that we reasonably consider unlawful, offensive, defamatory, misleading, infringing or otherwise inappropriate.

22. Errors and Changes to Website Information

Website information may occasionally contain typographical errors, inaccuracies or omissions relating to products, prices, promotions, availability, delivery charges or other information.

We reserve the right to correct such errors and to update information or cancel an order where information is materially inaccurate, subject to applicable law.

23. Liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or a consumer's statutory rights.

For business customers, to the fullest extent permitted by law, we will not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of business, loss of anticipated savings or business interruption.

Subject to liabilities that cannot lawfully be excluded or limited, our total liability to a business customer in respect of an order will not exceed the price paid for the relevant products giving rise to the claim.

24. Indemnity

To the extent permitted by law, a customer agrees to indemnify Metal Gutter Brackets UK against losses, damages, liabilities or claims arising from the customer's breach of these terms, violation of law or third-party rights, or misuse of our website or Services.

25. General

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

No waiver of any provision will be effective unless made in writing.

These terms, together with the applicable order, policies and any written agreement relating to the products, form the agreement between you and us in relation to the purchase.

You may not transfer or assign your rights or obligations under these terms without our prior written consent. We may transfer or assign our rights and obligations where permitted by law.

The headings in these terms are for convenience only and do not affect their interpretation.

26. Governing Law and Jurisdiction

These terms are governed by the laws of England and Wales.

Subject to any mandatory consumer rights concerning jurisdiction, the courts of England and Wales will have jurisdiction over disputes arising from these terms or any contract between us.
